The delivery date shall be deemed approximate and performance is subject to delays caused by strikes, fires, acts of God or other reasons not under the control of the Space Plus LLC. Lead time for custom orders is between 9 – 10 weeks from receipt of deposit & signed order. Lead time for standard items from stock is 10 – 14 days from receipt of deposit and signed order. Once the delivery is made to the customer, the risk of loss as to damage or destruction is assumed by the customer. The total price provided applies to the items that were quoted. If there are any changes requested by the customer, the price will be adjusted in writing and submitted to the customer for final approval and signature. No changes will be made once the order has gone to the factory for production.
Orders are not subject to cancellation. If for any reason, the customer desires to cancel their order of custom designed office enclosures, room dividers or other products (prior to production), their deposit will not be refunded and the customer will be subject to a 20% design fee. If the customer attempts to cancel an order after it has specifically been made for them, the customer will be responsible to pay for the order in full as originally approved. Should the customer desire to cancel an order of standard stock items prior to 72 hours before the scheduled ship date, the deposit will not be refunded and a 10% cancellation fee will apply.
All customers are required to pay a 50% deposit with their signed order and the balance upon shipment. The customer authorizes Space Plus LLC to immediately order materials and parts required to fulfill their order.
The customer understands that the office dividers, privacy walls, room dividers and other related products are especially designed for their order and that special care is taken to produce their order at the time the sales order is approved and deposit received.
Color may appear to vary from doors shown in our showroom when doors are placed in a room with various levels of lighting. Windex or warm water on a soft cloth may be used to clean the panels. No heavy detergents of any kind should ever be used to clean the glass doors. Space Plus LLC is not responsible for any damage due to cleaning products used by the customer or their agents. For room dividers & office dividers where divider strips will be used, it is recommended to put strips on both back and front of each door.
No installation, electrical wiring, flooring, decorating, painting or other construction work or repair will be provided by Space Plus LLC. In the event that these services are needed, Space Plus LLC may recommend one or more companies that are qualified to do this work; however, it is the customer's responsibility to hire and pay for these services. It is understood that the price for installation will be clearly identified on the quote/order form and is related to Space Plus LLC products only.
Space Plus LLC is not responsible for damage to walls, floors, ceilings or other structures during the course of normal removal of the customer's existing storage enclosure panels. A fee may apply for the disposal of any existing panels and will be indicated on the quote form. Repair work for the walls, floors or ceilings is the sole responsibility of the customer. Customer acknowledges that Space Plus LLC is not responsible for any pre-existing conditions of the installation area such as their lighting, heating, air conditioning or sprinklers, uneven floors or walls. The customer will hold Space Plus LLC harmless for any injury that may occur from their product as they are installed by an independent contractor or other third party.
The customer agrees to clear the pathway of any objects that may prevent the installers from having easy access to the area. If for any reason, the customer advises that the installation cannot take place once the installer arrives on site at the scheduled time, the customer will be charged for the installation and for the re-scheduled appointment as well.
Title to the products will only pass to the customer upon final payment to Space Plus LLC. In the event that any product is defective for reasons that occurred during transport or other reasons, the customer shall be entitled to repair or replacement at the discretion of Space Plus LLC. The customer shall not be entitled to recover incidental, consequential, professional or emotional damage of any kind.
Delays in payment are subject to a 20% per annum fee. If Space Plus LLC is required to engage the services of a collection agency or an attorney for any amounts due under these terms and conditions, the customer agrees to reimburse Space Plus LLC for expenses & unpaid balance due.
If client cannot take the doors as scheduled and wishes for us to store the order for them, payment is still due in full based on the originally agreed upon shipping date. The maximum amount of time any order will be stored is one month at a rate of $200 per month or $50 per week. If the order is not called for and shipped within 1 month, the client agrees to make other storage arrangements immediately.
If any of the sections in these terms and conditions are declared invalid, the remaining provisions of these terms and conditions will remain in tact. The customer acknowledges that they have reviewed, understood and approved their order & that it supersedes any verbal representation. No agent of Space Plus LLC is authorized to make any changes in this document.
These terms and conditions are governed by the laws in the state of California. The customer agrees that any claim shall not be cause for failure to make payment in full on the order. Any unresolved controversy or claim arising from these terms shall be settled by arbitration in Los Angeles, California. The prevailing party in the arbitration shall be entitled to recover attorney's fees in connection with the arbitration and enforcement of the award.
